Council position on revised IPPC/Industrial Emissions Directive – 26 June 2009Published on 22-07-2009

The Commission (COM) proposed this recast by the end of 2007, the Parliament (EP) has finalised its first reading in March 2009 and the Council has come to an agreement on June 25 during a meeting of the ministers of environment that will be the basis for the Council Common Position. According to the latest Council agreement, newly constructed power plants should be subject to the directive two years after its entry into force. For existing power plants the deadline is set to 2016. Ministers have agreed on transition periods up to 2023.

The Council agreement now foresees a Transitional National Plan. (Art. 33b)

This plan will cover combustion plants that were granted a permit before 27 November 2002 and that generated power before 27 November 2003. For gas turbines, only NOx emissions can be covered by the plan.

Chapter 3 and Annex 5 include detailed regulation and ELVs for the power sector. Both the COM and EP aim to extend the scope and include combustion plants between 20-50MW. The Council has clearly stated to leave the scope of the directive untouched (Annex I 1.1.).
